Terms of service

Effective 15 August 2026 · Trademark Search is operated by Prometheus Labs, Kitchener, Ontario, Canada ("we", "us").

1. The service

Trademark Search searches public U.S. (USPTO) and Canadian (CIPO) federal trademark records and reports factual matches: identical, similar-looking, and similar-sounding marks, with status, owner, and goods and services details from the official records.

2. Not legal advice

Trademark Search is a search tool, not a law firm, and nothing on this site or in a report is legal advice. Results are factual matches against public records and do not determine whether a name is available to use or register. Using the service creates no lawyer-client relationship. For a legal opinion on adopting or registering a name, consult a licensed trademark lawyer or agent.

3. What the search covers, and what it does not

The corpus holds live and pending federal filings from the USPTO and CIPO, refreshed weekly from official government feeds, plus records that recently became inactive. It does not include U.S. state registrations, common-law (unregistered) marks, other countries' registers, or logo and design elements. Government feeds can lag or contain errors, and every search is a snapshot of the records at the time it runs. "Nothing found" is never a promise that a name is available.

4. Purchases

Prices are in US dollars; applicable taxes are added at checkout. Payments are processed by Stripe.

5. Refunds

If a report did not do what you needed, reply to your receipt email within 30 days and we will refund it. Watch subscriptions can be cancelled anytime; cancellation stops future billing.

6. Acceptable use

Do not scrape or bulk-harvest results, resell the service, probe it for vulnerabilities, or use it to send unsolicited messages. The underlying trademark records are public and available from the USPTO and CIPO at source.

7. Service quality and liability

The service is provided "as is", without warranties of accuracy, completeness, or fitness for a particular purpose. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages or for decisions made using search results.

8. General

We may update these terms; material changes will be posted here with a new effective date. These terms are governed by the laws of Ontario and the federal laws of Canada applicable therein. Support is available at hello@prometheuslabs.ca.
